Welcome to Body & Soul by Carly. By accessing or using our website (bodyandsoulbycarly.com) and booking our services, you agree to be bound by these Terms of Service. Please read them carefully before proceeding.
1. About Our Services
Body & Soul by Carly offers physical therapy and therapeutic bodywork services in Miami, Florida. Our website provides information about our services and allows clients to submit contact inquiries and appointment requests.
2. Eligibility
By using our website or services, you represent that:
You are at least 18 years of age, or have parental/guardian consent
You are legally capable of entering into a binding agreement
You will provide accurate and complete information when contacting us
3. Health Disclaimer
Body & Soul by Carly provides licensed physical therapy, therapeutic bodywork, wellness services and health education designed to promote improved movement and function, pain relief and overall wellbeing.
Under Florida law, a licensed physical therapist may evaluate, diagnose and treat without a physician referral within the scope and limitations permitted by applicable law. However, physical therapy is not a substitute for medical care when symptoms require evaluation or treatment by a physician or other qualified healthcare provider.
The information provided on this website is for general educational and informational purposes only and should not be interpreted as individualized medical advice or as establishing a therapist-patient relationship. Individual recommendations are made only after an appropriate evaluation by a licensed physical therapist.
By booking a session, you confirm that you have disclosed any relevant medical history, injuries, surgeries and medications to your therapist prior to or during your appointment. You assume full responsibility for any risks arising from failure to disclose such information. It is the patient’s responsibility to notify the therapist of any changes in your health status prior to treatment.
Understand that outcomes vary from person to person and that no specific results or guarantees are promised. While every effort is made to provide safe, evidence-based care, participation in physical therapy and bodywork carries inherent risks, including temporary soreness, discomfort, bruising, aggravation of existing symptoms, or, in rare cases, injury. By voluntarily participating in services, you acknowledge these risks and consent to treatment within the scope of your therapist’s professional judgment. Note that Bioelectric Meridian Therapy (BMT) is a complementary wellness modality rather than a substitute for medical care. Clients reserve the right to decline or stop treatment at any time.
If you experience chest pain, difficulty breathing, sudden weakness, loss of consciousness, severe trauma or any other medical emergency, call 911 and seek immediate medical care. Do not rely on this website or delay seeking medical attention because of information provided by Body & Soul by Carly.
4. Appointments & Cancellations
Appointment requests submitted through our website are subject to availability and confirmation. We reserve the right to decline or reschedule appointments at our discretion.
Appointments are reserved exclusively for each client. We respectively request 24 hours’ notice of cancellation or rescheduling. No-shows or late cancellations with less than 24 hours’ notice may be charged up to the full appointment fee. Late arrival will result in treatment for the remainder of the allotted appointment time with the original agreed upon cost of service.
5. Payments
Payment terms, accepted methods, and pricing will be provided at the time of booking. All prices are subject to change without notice. Payments must be completed as agreed prior to or at the time of service.
Body & Soul by Carly is a cash-based practice. We do not bill insurance companies or participate with insurance plans. Upon request, clients may receive a receipt of service.
6. Code of Conduct
We are committed to providing a safe and professional environment. Any inappropriate, harassing, or disrespectful behavior toward our staff will result in immediate termination of the session without refund and may result in being banned from future bookings.
Our services are strictly therapeutic in nature. Any requests or behavior of a sexual nature will result in immediate session termination and may be reported to authorities.
7. Intellectual Property
All content on bodyandsoulbycarly.com, including text, images, logos, and design, is the property of Body & Soul by Carly and protected by applicable copyright laws. You may not reproduce, distribute, or use any content without prior written permission.
8. Limitation of Liability
To the maximum extent permitted by law, Body & Soul by Carly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Our total liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim.
Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our website will be error-free or uninterrupted.
9. Indemnification
You agree to indemnify and hold harmless Body & Soul by Carly from any claims, liabilities, damages, losses, costs or expenses arising out of your use of the website or violation of these Terms of Service.
10. Governing Law
These terms of service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
Any disputes arising from these Terms or the use of our services shall be resolved in the appropriate state or federal courts located in Miami-Dade County, Florida.

Body & Soul by Carly reserves the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes constitutes your acceptance of the revised Terms.
